Argentina Wants Companies Run by AI Agents. What Does It Mean for Your Business?

Argentina's government took to the UN the idea of granting limited liability and tax benefits to companies that operate with artificial intelligence agents. Here is what is already law, what is still under debate, and what a company can do today without waiting for the new rules.

By Intermedia Group. Updated October 2026. 7-minute read.

The short answer

Argentina does not yet have a law for companies run by AI agents. A bill for a new General Companies Law is before the Senate (file PE-193/26) and creates a new figure called the Automated Company (Sociedad Automatizada). On September 23, 2026, President Javier Milei told the UN General Assembly that the country will seek to offer limited liability and tax benefits to these companies. In the meantime, any Argentine corporation (SA), limited liability company (SRL) or simplified stock company (SAS) can already use AI agents in its operations under current rules.

What was announced at the United Nations

In his speech to the 81st General Assembly, Milei listed artificial intelligence among the pillars of Argentina's investment strategy, alongside critical minerals, energy and talent. Within that plan he named two instruments: limited liability for companies that operate with AI agents, and tax benefits.

The announcement sets a direction, but on its own it changes no rules. It does not create a new regime, and it does not allow anyone to incorporate this type of company today.

What an Automated Company is

The figure appears in the bill for a new General Companies Law that the Executive sent to the Senate on June 1, 2026, to replace Law 19,550, in force since 1972. Under the original text, an Automated Company is a company of any type allowed by the law that carries out its business purpose through autonomous algorithmic systems or AI agents, without needing employees for its ordinary operations.

Three clarifications prevent the most common misunderstandings:

  • AI does not become a legal person. The company remains the holder of rights, obligations and assets. The agents run the operations.

  • Limited liability does not mean nobody is liable. The bill states that the company is liable with its own assets to third parties for damage caused by its agents.

  • Directors are not off the hook. Using AI does not remove their duty to configure and supervise the systems, or their responsibility for the outcomes.

Where the bill stands

The bill sits with the Senate's General Legislation Committee, and the debate has drawn sharply different views. Key milestones:

  • June 1: the bill reaches the Senate as file PE-193/26.

  • June 24: Deregulation Minister Federico Sturzenegger and Justice Ministry officials present it to the committee.

  • August 11: a hearing with experts for and against automated companies.

  • August 19: the ruling party announces it will add an accountable natural or legal person to the management of automated companies.

  • September: more than thirty civil society organizations ask the Senate to remove those articles, citing constitutional objections and concerns about human control of the systems.

  • September 23: Milei presents the proposal at the UN.

At the time of writing, the committee had not issued its report. If the bill passes, implementing regulations will still be needed before the figure can be used in practice.

What about tax benefits

The announcement did not specify which instrument will deliver the new benefits. These regimes are in force today:

Regime

Who it is for

What it offers

Knowledge Economy (Law 27,506)

Companies in knowledge-based activities, including AI-based automation

Tax credit of up to 70% of certain employer contributions, and an income tax reduction of 60% (micro and small), 40% (medium) or 20% (large companies) on qualifying activities.

RIGI

Large investments, with a general minimum of USD 200 million

Since Decree 105/2026 it explicitly includes AI in the technology sector. 25% income tax rate, accelerated depreciation and tax stability.

RIMI

Mid-sized productive investments

Accelerated depreciation and VAT mechanisms, subject to the regime's conditions.

Specific benefit for AI agents

To be defined

Announced at the UN; no rule published yet.

What a company can do today

There is no need to wait for the law. A company can deploy AI agents today within its current legal structure. What the Senate debate does make clear is the standard any future regulation will follow: identifiable human oversight and accountability for what the system does. Companies that set this up from the start will not have to rebuild their operations when the rules change.

In the projects we deliver at Intermedia, this is the order that works:

  1. Pick a process with clear rules and high volume: invoice processing, reconciliations, answers to frequent questions or order tracking.

  2. Define what the agent decides on its own and what needs human approval, for example payments or commitments above a set amount.

  3. Assign a named human owner to each agent.

  4. Log every action: what data the agent used, what it decided and what it changed. That log lets you audit, fix errors and show due diligence if needed.

  5. Review how personal data is handled (Argentine Personal Data Protection Law 25,326) and the client and supplier contracts the agent will touch.

  6. Measure results before adding the next process.

This is how we work with Lirina: we start from agents already built for areas such as administration, procurement, customer service and HR, adapt them to each company's workflows, connect them to its systems and track their performance with usage controls by area and by user.

Frequently asked questions

What is an Automated Company in Argentina?

It is a figure in the bill for a new General Companies Law (file PE-193/26): a company of any type that carries out its business purpose through autonomous algorithmic systems or AI agents, without needing employees for its ordinary operations.

Can you incorporate an Automated Company in Argentina today?

No. The bill is still with the Senate's General Legislation Committee. If it passes, it will also need implementing regulations.

Does limited liability mean nobody answers for an AI agent's mistakes?

No. The company is liable with its assets for damage caused by its agents, and directors keep the duty to configure and supervise the systems.

Do companies need to wait for the law to use AI agents?

No. An SA, SRL or SAS can use AI agents today under current rules. The law would create a specific figure for companies designed from the start to operate that way.

What tax benefits exist today for companies using AI in Argentina?

The Knowledge Economy regime, which covers AI-based automation, the RIGI for investments of USD 200 million or more, and the RIMI for mid-sized investments are in force. The specific benefits announced at the UN have no rule yet.

Where should a company start?

With a repetitive process that has clear rules, a named human owner, defined approval limits and a log of every action the agent takes.
